§ 1. To whom do these general terms of use apply.

This website www.random-colours.com is a part of RANDOM-COLOURS.COM

We at RANDOM-COLORS in the form of the RANDOM-COLORS company specified on our website in the imprint (hereinafter also “RANDOM-COLOURS.COM” or “We”) want you to the community, our customers, and also the fans, through our websites and apps (hereinafter “platforms”) make our products, content and services available at any time and further develop them together with you.

We want to show the conditions between us and you for our products, services and content with these general terms of use so that a good common basis for our cooperation is created (hereinafter “rules”).

§ 1a. The online shop

One of our most important areas for you is probably our online store. Therefore we put this area right at the beginning. You can find everything about this under

§ 1a.- 8.

When will I receive my order?

§ 2 shipping:

It usually takes 3 – 7 days to process an order, after which it will be shipped. The delivery time depends on your location and is estimated as follows:

● Europe: 6 – 8 working days

● USA: 3 – 4 business days

● Australia: 2-14 business days

● Japan: 4 – 8 business days

● International: 10 – 20 working days

In general, it is difficult to predict the shipping times exactly. But one thing is certain, we work quickly.

Where will my order be shipped from?

We work with partner companies that handle orders with facilities around the world!

Will I be charged customs duties for my order?

An additional duty and tax fee may apply to international orders. This fee is beyond our control and is determined by the local customs office. Customs regulations vary from country to country. Therefore, please inquire directly at the local customs office whether they levy duties and taxes on your purchases.

My order should be here by now, but I still don’t have it.

What should I do?

Before you get in touch, please help us as follows:

● Check the shipping confirmation email for errors in the delivery address.

● Check with the local post office to see if you have received the package.

● Inquire with your neighbors whether the courier has delivered the package to them.

If the delivery address was correct and the package was not delivered to the post office or your neighbor, contact us at support@random-colours.com with the details of your order number. If you found a mistake in your delivery address, we can send you a replacement order, but shipping will be at our own expense.

Orders

How are the products made? We work with a partner who has locations all over the world. Depending on where you are, orders will be processed and shipped by the facility that can do this most efficiently!

How can I track my order?

You will receive a tracking link by email when your order is shipped. If you have any questions about tracking or your shipment, write us an email at support@random-colours.com

I received the wrong / damaged product, what should I do?

We are very sorry if the product you ordered arrived damaged. To help us fix this quickly, please send us an email within one week with photos of the damaged product, the order number and any other details you have about your order to support@random-colours.com We will get back to you as soon as possible to send a solution!

Returns

What is your return policy?

We don’t offer returns or exchanges, but if there is something wrong with your order please let us know by contacting us at support@random-colours.com! Do you offer refunds?

Refunds are only offered to customers who receive the wrong or damaged items. If any of these points apply, contact our customers at support@random-colours.com with photos of the wrong / damaged items and we will sort it out.

Can I exchange an item for a different size / color? We currently do not offer exchanges. If you’re not sure which size fits better, check out our size charts. We have one for every item in our store in the product description. While it’s rare, it is possible that an item you ordered was mislabeled. If so, please let us know within one week of receiving your order at support@random-colours.com. Include the order number and photos of the mislabeled item. We will send you a new one or refund the purchase price!

§ 2 Scope

These general terms and conditions apply to all legal transactions between RANDOM-COLORS and a consumer forth a “natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.

§ 3 Conclusion of the contract and storage of the contract text

The provisions of these terms and conditions apply to orders that consumers place via one of our online shops.

The contract is concluded with RANDOM-COLOURS.COM (see § 1).

The presentation and description of the goods on the RANDOM-COLOURS.COM website does not constitute a contract offer.

By ordering goods by clicking on the “BUY” button at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is only concluded when an order confirmation is sent by email from RANDOM-COLOURS.COM.

The text of the contract is saved with orders. Consumers receive an email with the order details and the applicable terms and conditions. After the conclusion of the contract, the order data can no longer be viewed online.

§ 4 payment

An additional duty and tax fee may apply to international orders. This fee is beyond our control and is determined by the local customs office. Customs regulations vary from country to country. Therefore, please inquire directly at the local customs office whether they levy duties and taxes on your purchases.

§ 5 delivery, delivery restrictions

Unless the description of a selected product explicitly stipulates otherwise, delivery takes place within 7 working days.

In the case of payment via bank transfer or PayPal, this period begins on the day after the payment order has been issued.

§ 6 Transfer of Risk

The risk of accidental deterioration or accidental loss of the goods lies with RANDOM-COLORS until the goods are handed over and is transferred to the consumer when the goods are handed over.

§ 7 retention of title

The user retains ownership of the goods until the purchase price has been received in full.

§ 8 Warranty

The statutory warranty regulations apply.

§ 9. Content-related areas of application

The general terms of use apply to the use of all products, content and services made available to you on our platforms (hereinafter also referred to as “content”). The use includes any use of the content. It starts with visiting and browsing our websites and apps, goes through sign-ups for, newsletters or similar offers, downloads and streaming’s, blogs to registering and creating user accounts.

§ 10. Your obligations as a user

Mutual appreciation and consideration as a basic condition, because that’s how it should be.  So no hate speech, slander or other content.

We make our content available to you as a private person for your private use. This means that this content may not be used commercially or otherwise profitably by you.

§ 11. Termination

If we find that it does not work for you and the rules outlined, in particular if these rules are violated, we reserve the right to terminate the contract at any time.

§ 12. Contents and services of RANDOM-COLOURS.COM

5.1 All rights to the content of RANDOM-COLORS reserved. All content on our pages, including the content and services provided by you or third parties, i.e. in particular all texts, logos, brands, graphics, works of art, sounds, music and software (including the access software) are protected by copyrights, personal rights, utility models, patents, trademarks, service marks, design rights, database rights, trade secrets, trust rights and other similar rights (“IPR”).

All intellectual property rights that exist in the Platforms and their content are either owned by or licensed to us. All rights are reserved by us or, if provided by a third party, by the third party (and even if such content or service is not expressly identified as legally protected or registered, this does not mean that we or any third party have any relation to such content or service completely or partially waive applicable intellectual property rights).

You may not reproduce, copy, post, republish, send, record, transmit or edit any content, materials, or any part thereof, nor do you do anything or attempt anything that violates our intellectual property rights or any other without our express prior written consent infringes intellectual property licensed to us or owned by third parties. The same applies to ideas and concepts on which the platforms or the content are based, even if they are not protected by intellectual property law.

Usage license for the use of our platforms and contents To ensure that your use of our platforms is not restricted when you visit our platforms, despite our extensive rights, you will receive a simple license from us for your purely private use of our content. We grant you this license so that you can use our services for yourself at home or as a private person on the go.

This means, in particular, that this license does not include any use beyond that in the context of your commercial business ideas or other commercial activities, reproduction, modification or exploitation. You cannot transfer this license to third parties.

Third party content Our platforms can use or integrate digital content or services from third parties (hereinafter referred to as “third party content”). You acknowledge and agree that your right to use such third party content or third party services may be subject to additional terms and conditions of the third party providing these services. If you do not agree to these additional conditions, you may not use the respective content or services of third parties.

§ 13 final provisions

(1) The contract language is English.

(2) The law of Hong Kong applies to contracts between the seller and the customer, excluding the laws on the international purchase of movable goods. This choice of law applies to consumers only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer is habitually resident is not withdrawn from the customer.

(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seat of the seller. This also applies if the customer does not have a general place of jurisdiction in Hong Kong, or if his place of residence or usual place of residence is not known at the time the action is brought.
